Rola organizacji pozarządowych w procesie konsultacji publicznych i w opiniowaniu – wnioski z badań

Abstrakt

W artykule zaprezentowano wnioski z badania dotyczącego udziału organizacji pozarządowych w konsultacjach publicznych i opiniowaniu na poziomie rządowym, przeprowadzonego przez autorkę dla Ogólnopolskiej Federacji Organizacji Pozarządowych latem 2018 roku. Wynika z nich, że obecnie można zaobserwować obniżenie jakości i standardów procesów konsultacji publicznych. W toku badania negatywnie oceniono istnienie zjawiska „szarej strefy procesu legislacyjnego”, co niesie niekorzystne skutki dla jego transparentności, zarekomendowano również konieczność ustawowego zwiększenia roli trzeciego sektora w procesie konsultacji. Badania wykazały, że rola oceny skutków regulacji nie jest w pełni wykorzystywana – wobec powyższego zalecono  wprowadzenie obowiązku prowadzenia konsultacji z realnymi terminami ich dokonywania.

The role of non-governmental organisations in the process of public consultations and the issue of opinions – Study results

Abstract

This article presents the results of the study on NGO participation in public consultations and issue of opinions at the national level performed by the author for the National Federation of Non-Governmental Organisations in the summer of 2018. It shows that, recently, both the quality and the standards of public consultations have deteriorated. The existence of the “grey zone of the legislative process” is noted and assessed as detrimental to transparency. The recommendation of the study is to increase the role of the third sector in consultations, if only through full implementation of current statutory solutions. The study has proved that the Evaluation of the Effects of Regulations is not used to its full extent; hence the recommendation to introduce the obligation of consultations subject to specific deadlines.
